North American Veterinary Blood Bank Liability Statement for Friday Shipments

By placing an order with the North American Veterinary Blood Bank (NAVBB) for any shipment scheduled to be delivered on a Saturday, the buyer acknowledges and agrees to the following terms:

1. No Guarantee of Delivery
NAVBB does not guarantee or insure the timely delivery of any shipment sent on a Friday for Saturday, arrival. Due to the potential for carrier delays, carrier saying business is closed, no one able to accept shipment, or unforeseen circumstances beyond our control, NAVBB cannot guarantee that the shipment will arrive on the intended date.

2. Buyer Assumes Risk
The buyer assumes all risks associated with the shipment being delayed or not delivered on the expected Saturday, delivery date. This includes, but is not limited to, delays caused by weather, carrier issues, or other third-party factors.

3. No Refunds or Replacements
NAVBB will not issue refunds or provide replacement products for any shipment that is delayed or not delivered as scheduled for a Saturday, arrival. The buyer agrees that all products ordered for Friday shipment are purchased "as is" and accepts the potential risks.

4. Exclusion of Carrier Liability on weekends
NAVBB is not responsible for any delays, damages, or non-delivery caused by the shipping carrier. Once the shipment has been handed over to the carrier, the responsibility for delivery lies solely with the carrier and the buyer.

5. Shipping Address Accuracy
It is the buyer’s responsibility to provide accurate and complete shipping information. NAVBB will not be held liable for delays or non-delivery caused by incorrect or incomplete addresses provided by the buyer.

6. Force Majeure
NAVBB shall not be held liable for any delay or failure in performance caused by acts of God, natural disasters, government restrictions, labor strikes, or any other event beyond its reasonable control.

7. No Warranty on Perishable Goods
NAVBB makes no warranties, express or implied, with respect to the condition of perishable products during transit. The buyer assumes all risks for any changes in the condition of the products during shipment for arrival on Saturday.

8. Responsibility for Product Handling After Delivery
Once the shipment has been delivered to the specified address, NAVBB assumes no responsibility for the proper handling, storage, or use of the products. It is the buyer’s responsibility to ensure products are handled according to applicable safety and regulatory guidelines.

9. Acknowledgment of Shipment Risks
By confirming an order for a shipment to be delivered on a Saturday, the buyer acknowledges the risks of potential delay or non-delivery and agrees to these terms without reservation.

10. Indemnification Clause
The buyer agrees to indemnify, defend, and hold harmless NAVBB from and against any claims, losses, damages, liabilities, and expenses arising out of or related to the buyer’s failure to receive the shipment on the expected Saturday, delivery date.

11. Non-Liability for Special or Consequential Damages
In no event shall NAVBB be liable for any special, incidental, or consequential damages, including but not limited to loss of profits, revenue, or data, arising out of the delay or failure of shipment for Saturday, delivery.

12. Governing Law This agreement will be governed by and construed in accordance with the domestic laws of the Commonwealth of Virginia, without giving effect to any choice of law or conflicting provision or rule (whether of the Commonwealth of Virginia or any other jurisdiction) that would cause the laws of any jurisdiction other than the Commonwealth of Virginia to be applied. In furtherance of the foregoing, the internal laws of the Commonwealth of Virginia will control the interpretation and construction of this agreement, even if under such jurisdiction’s choice of law or conflict of law analysis, the substantive law of some other jurisdiction would ordinarily apply.

13. Final Agreement
By placing an order for a Friday shipment, the buyer agrees to waive any claims against NAVBB for non-delivery or late delivery of the shipment and understands that NAVBB will not be held responsible for any losses incurred as a result of such delays.
